Game and Community Laws of Shaiya PH The following are the laws that govern Amped and user interaction, relationships and activities within SHAIYA ONLINE PHILIPPINES, its community, and its properties. This henceforth divided into Articles and Sections that each may be guided with transparency and without doubt.

Revisions to improve these policies could be done by Amped without consent and prior notice and shall be effective after 7 days of its publishing.

Some firewall programs will block Shaiya, disallowing the game from accessing the server. If you receive a "Cannot connect to server" or "Cannot change directory.c35" error when trying to play, please make the proper adjustments to your firewall program(s).
  • Usership

    Section 1. The following are Shaiya Online Philippines users: (1) Those who have registered in Shaiya Online Philippines through the Amped official website: www.amped.ph (2) Those who have played Shaiya Online Philippines.


    Section 2. Those who have played Shaiya Online Philippines but have transferred to any other game from Amped are still considered Shaiya users unless he or she revoked his or her usership.


    Section 3. Those who have played Shaiya Online Philippines but have transferred to any other game not from Amped are still considered Shaiya users unless he or she revoked his or her usership.


    Section 4. Those who have played Shaiya Online Philippines but whose Amped accounts have been banned, blocked or suspended may still be considered a Shaiya Online Philippines user unless he/she revoked his usership.


  • Account Responsibilities

    Section 5. Each account is treated as a separate entity and can be owned only by one (1) user. Having different users on one same account is strictly not allowed, and is not a valid reason for any appeal in cases such as but not limited to account recovery & claiming of prizes.


    Section 6. Information registered by the user shall be kept with confidentiality by the user. This information will be used for security purposes such as but not limited to account recovery & claiming of prizes.


    Section 7. Amped account passwords shall never be given away to anyone; person or persons, and or websites. Passwords will never be asked by the Game Masters.


    Section 8. Purchase of accounts from other users is deemed illegal and should be under the discretion of the user. The Amped team shall not be liable for any cases of scamming or fraud. Claims for account restoration shall not be entertained by Amped.

Section 1. The Amped team members are the current regular and contractual ABS-CBN Multimedia employees which include the following but are not limited to:

1. Game Masters
2. Product Managers
3. Customer Service Representatives
4. Sales Representatives
5. Brand Activation Agents (I-CARE Team)


Section 2. The following are members of the Amped team but may only be for a short period of time and are not regular or contractual employees of ABS-CBN Multimedia:

1. Forum Guardians
2. Shaiya Wardens
3. Game Assistants


Section 3. The following are not members of the Amped team and are not employees of ABS-CBN Multimedia:

1. Game Card Distributors
2. Game Card Retailers

Shaiya Online Philippines is an Online Game developed by Choi Rock and published by Amped. Sovereign resides in Amped and Choi Rock, and all authority over the community emanates from Amped.
  • Gamemaster

    Section 1. The primary duties of the Game Masters (GMs) are the following: to ensure that Shaiya is technically stable and economically healthy; to maintain the balance of the community through maintenance of servers; to conceptualize and execute in-game, offline, online and ground events; to contribute in planning of sales and marketing activities; to contribute in the overall product management of Shaiya; and to enforce the law to the community.


    Section 2. A GM’s authority is at all times superior to Game Warden, civilian, community and user authority. The Game Master shall be respected and revered at all times.

  • Gamewardens

    Section 3. Game Wardens are civilian users chosen by the GMs to aid them in enforcing the law, keeping the balance of the community, and helping new users get accustomed to Shaiya’s gameplay.


    Section 4. Wardens’ authority is at all times superior to civilian, community or user authority but is inferior to the GM’s authority. Wardens shall be respected and revered by all users at all times.

  • Policies

    Section 5. GMs and Wardens shall promote social justice in all phases of the Shaiya community.


    Section 6.GMs and Wardens shall value the dignity of every user and guarantee full respect for user rights.


    Section 7. GMs and Wardens shall equally recognize the role of men and women in community-building, and shall ensure that no biases against genders shall influence their decisions or in any way affect the community.


    Section 8. GMs and Wardens shall protect and promote the right to health of the users and instill health consciousness and balanced lifestyle among them. Thus, they shall not force users to play in time and durations that may compromise their health.


    Section 9.GMs and Wardens shall give priority to the education and family of the user. Thus, they shall not force or encourage users to neglect their responsibilities over their education and their families.

  • User Rights

    Section 1. No person shall be deprived of property and liberty to play Shaiya without due process of the Shaiya laws nor shall any person be denied equal protection of the Shaiya laws.


    Section 2. The privacy of communication and correspondence shall be inviolable except upon lawful order of the GMs or when other users’ safety or order requires otherwise, as prescribed by law.


    Section 3. Communication and expression of thoughts and emotions shall be allowed except when the words used are to deliberately insult or offend another person or persons belonging to the same faction, promoting non-Amped games or services, or are sexual or defamatory in nature.


    Section 4. The right of all persons to form guilds for purposes not contrary to law shall not be abridged.


    Section 5. Every person can explore, hunt, and grind in any area not restricted to his faction, level or as restricted by Amped.


    Section 6. No law shall be passed abridging the freedom of speech, and of expression.


    Section 7. Every person can use and/or talk to any NPCs not restricted to his faction, level or as restricted by Amped.


    Section 8. Every person can use attack, hunt, kill and loot to any hostile NPC not restricted to his faction, level or as restricted by Amped.


    Section 9. Every person has the right to name their characters and guilds in any way not restricted by Amped, and should not use names that are sexual and defamatory in nature, and are not confusingly similar to any existing real-life person, real-life property, in-game character, or guild which are not his or her own.


    Section 10. The Shaiya law shall provide for sanctions for violations of this Section.


    Section 11. A person’s rights shall not be suspended except in cases of rebellion against Amped, or when the balance and harmony of the community requires it.


    Section 12. In all in-game prosecutions, the accused will be given the liberty to be heard by himself, Wardens and GMs but will not necessary negate a verdict as long as evidences support the allegations against the accused.

  • Game Master (GM) Rights

    Section 13. GMs have all the access to any information the users have provided in their Amped account only when such information is needed in events, account restoration and but not limited to user offense investigations.


    Section 14. Punishment may be cast by the GM’s to any offender anytime even without prior notice to the offender provided the punishment is just and is according to the law.


    Section 15. Testing of game features such as but not limited to: items, monsters, NPCs, and maps may be conducted by the GMs for purposes such as but not limited to: conceptualizing of events, detecting of errors, and 3rd party software is allowed without notice to the users as long as the tests do not interfere or disturb users, damage properties, and compromise the overall health of Shaiya in any way.


    Section 16. Distribution of items can only be done by GMs as indicated in event mechanics.


    Section 17. GMs have authority to correct any error, human or technical, to items dropped, rewarded or purchased without consent to any user party involved to ensure the balance of the game.


    Section 18. GMs have authority to aggravate or mitigate by one level any penalty enforced on an offender.

     

    Section 19.GMs reserve the right to evaluate every incident and take action they consider applicable to resolve the case.

  • Section 1. Hacking, cracking, and usage of third-party programs shall not be tolerated by Amped: its Game Masters, Game Wardens, and its community.


    Third-Party Programs

    Section 2. Third-party programs are software not officially provided by Amped which can do the following:

    1. Alter the Shaiya game mechanics, numbers, stats, codes, and other game assets such as but not limited to animations, textures, maps, objects, items, texts, interface, and NPCs.
    2. Compromise the stability and or connectivity of the game. 3. Breach information restricted only to Amped and Choi Rock.
    4. Automate user directed functions.


    Section 3. Refers to unauthorized access into or interference in the Shaiya server, website, forum, and or social networking sites; or any access in order to corrupt, alter, steal, or destroy using a computer or other similar information and communication devices, without the knowledge and consent of Amped, including the introduction of computer viruses and the like, resulting to system corruption, destruction, alteration, theft or loss of electronic data messages or electronic document.

  • Official Websites

    Section 1. Only the websites in the subsequent sections are officially owned by Shaiya Online Philippines; all websites otherwise shall not be referenced for use in Shaiya Online Philippines, its events, news, and announcements. All new websites used by Amped for Shaiya will be announced in the forum, game launcher or the Shaiya or Amped official websites.

    Section 2. The Shaiya Online Philippines official website can be found in: http://shaiya.amped.ph/


    Section 3. The Shaiya Online Philippines official website shall be the primary medium used to communicate Shaiya events, features, news, and updates.


  • Forum

    Section 4. The Shaiya Online Philippines official forum can be found in: http://forums.amped.ph


    Section 5. The Shaiya Online Philippines official forum account is a different entity from the Amped game account.


    Section 6. Each account is treated as a separate entity and can be owned only by one (1) user. Having different users on one same account is strictly not allowed, and is not a valid reason for any appeal in cases such as but not limited to account recovery & claiming of prizes.


    Section 7. The Shaiya Online Philippines official forum has its own set of laws and penalties which can be found in this link.


    Section 8. The Shaiya Online Philippines official forum is the only place aside from the game, where Shaiya related discussions and concerns are entertained by Amped.


  • Facebook

    Section 9. The Shaiya Online Philippines official Facebook page can be found in: http://www.facebook.com/ShaiyaPH


    Section 10. The Shaiya Online Philippines official Facebook page shall be merely used to communicate Shaiya events, features, news, and updates.


    Section 11. GMs are not responsible for answering queries and concerns posted by Facebook fans. All concerns shall be posted in the forum.

    Section 12. The Shaiya Online Philippines official Twitter account can be found in: http://www.twitter.com/shaiyaph

  • Authority

    Section 1. The judicial power shall be vested in Amped: its Game Masters, and Game Wardens.


  • Website

    Section 2. The Game Masters and Game Wardens shall have the following powers:

    1. Promulgate rules concerning the protection and enforcement of user rights.
    2. Conduct fair investigations on the parties of the accused and the accuser.
    3. Enforce penalties against violations.


  • Penalties

    Section 3. Violations committed in-game against a person or persons, Game Masters, and Game Wardens, shall be dealt with accordingly based on the Penalty Code of Shaiya Philippines, provided herewith.


  • Forum

    Section 4. Violations committed in Shaiya’s official social networking sites shall be dealt with according to the networking sites’ rules and regulations.


    Section 5. Violations against Article 5 shall be dealt by legal actions in accordance to the Philippine E-Commerce Law.

Book One - General Provisions

General Provisions Regarding the Date of Enforcement and Application of the Provisions of This Code, and Regarding the Offenses, the Persons Liable and the Penalties


Application of the Provisions of This Code

Article 1. The provisions of this Code shall be enforced only within the Shaiya in-game world, excluding its website, its forum and social networking sites, not outside of its jurisdiction, against those users and Game Wardens who should commit an offense while online Shaiya Online Philippines.


Article 2.The Shaiya Online Philippines official forum has its own penalties which should be applied by the Moderators, to felonies committed by users and Game Wardens within its jurisdiction.


Article 11. Mitigating circumstances — The following are mitigating circumstances:

1. That sufficient provocation or threat on the part of the offended party immediately preceded the act.

2. That the act was committed in the immediate vindication of a grave offense to the one committing the felony, his spouse, ascendants, or relatives by affinity within the same degrees.

3. That the offender had voluntarily surrendered himself to a person in authority or his agents, or that he had voluntarily confessed his guilt before the court prior to the presentation of the evidence for the prosecution.


Article 12. Aggravating circumstances — The following are aggravating circumstances:

1. That advantage be taken by the offender of his public position.

2. That the crime be committed in contempt or with insult to Amped.

3. That the crime be committed in consideration of a price, reward, or promise.

4. That the act be committed with evidence premeditation.


Article 3. Definitions

Acts and omissions punishable by law are felonies


Felonies are committed not only be means of deceit but also by means of fault.


There is deceit when the act is performed with deliberate intent and there is fault when the wrongful act results from imprudence, negligence, lack of foresight, or lack of skill.


Article 4. Felon liability.— Felon liability shall be incurred:

a. By any person committing a felony (delito) although the wrongful act done be different from that which he intended.
b. By any person performing an act which would be an offense against persons or property, were it not for the inherent impossibility of its accomplishment or an account of the employment of inadequate or ineffectual means.


Article 5. Consummated, frustrated, and attempted felonies

Consummated felonies as well as those which are frustrated and attempted, are punishable.


A felony is consummated when all the elements necessary for its execution and accomplishment are present; and it is frustrated when the offender performs all the acts of execution which would produce the felony as a consequence but which, nevertheless, do not produce it by reason of causes independent of the will of the perpetrator.


There is an attempt when the offender commences the commission of a felony directly or over acts, and does not perform all the acts of execution which should produce the felony by reason of some cause or accident other than this own spontaneous desistance.


Article 6. When light felonies are punishable

Light felonies are punishable only when they have been consummated, with the exception of those committed against person or property.


Article 7. Conspiracy and proposal to commit felony

Conspiracy and proposal to commit felony are punishable only in the cases in which the law specially provides a penalty therefore.


A conspiracy exists when two or more persons come to an agreement concerning the commission of a felony and decide to commit it. There is proposal when the person who has decided to commit a felony proposes its execution to some other person or persons.


Article 8. Grave felonies, less grave felonies and light felonies

Grave felonies are those to which the law attaches the major to capital punishment.


Less grave felonies are those which the law punishes with penalties which in their maximum period are correctional, in accordance with the above-mentioned article


Light felonies are those infractions of law for the commission of which a penalty of Provisional.


Article 9. Offenses not subject to the provisions of this Code

Offenses which are or in the future may be punishable under special laws are not subject to the provisions of this Code. This Code shall be supplementary to such laws, unless the latter should specially provide the contrary.


Article 10. Justifying circumstances — The following do not incur any felon liability:

1. Anyone who acts in defense of his person or rights, provided that the following circumstances concur:

- First: Unlawful aggression.
- Second: Reasonable necessity of the means employed to prevent or repel it.
- Third: Lack of sufficient provocation on the part of the person defending himself..

2. Anyone who acts in defense of the person or rights of his guildmate.

3. Anyone who acts in defense of the person or rights of a stranger, provided that the first and second requisites mentioned in the first circumstance of this Art. are present and that the person defending be not induced by revenge, resentment, or other evil motive.

4. Any person who, in order to avoid an evil or injury, does not act which causes damage to another, provided that the following requisites are present:

- First:That the evil sought to be avoided actually exists.
- Second:That the injury feared be greater than that done to avoid it
- Third: That there be no other practical and less harmful means of preventing it.

5. Any person who acts in obedience to an order issued by a Game Master for some lawful purpose.



Book Two: Offenses and Penalties

Article 30. Verbal Disrespect to a Game Master or Game Warden
A player found disrespecting a GM or Warden shall be punished with Provisional Silence to Provisional Suspension if it is of a serious and insulting nature, with the duration based on the discretion of the offended authority.


Article 31. Wrongful Accusation
Accusing a Game Master or Warden or any Amped team member without sufficient proof or evidence or an accusation proven wrong and is found with intention to tarnish the Amped team’s reputation is a grave offense and is punishable by Provisional Suspension to Perpetual Suspension.

Article 32. Promotion of Non-Amped Games and Services
Any player found mentioning the name of persons or titles of games and services not under Amped with the purpose of promotion of the game mentioned or the company or companies behind it, shall be punished with Provisional Silence to Provisional Suspension.


Article 33. Use of Third-party Software
Use of third-party software to automate user instructed functions is prohibited and any user found guilty of such use shall be Provisional Suspension.


Article 34. Hacking and Cracking
Illegal access and or modification of Shaiya game assets and data is a grave offense that could destroy the whole business and community of Shaiya. Any person found guilty with such act shall be awarded a penalty of Perpetual Suspension and will be dealt with accordingly based on the Philippine E-Commerce Law.


Article 35. Event Rules Disobedience
Disobedience to the event mechanics as declared by Amped with purposes of disrupting, delaying, or ruin an event is punishable by Provisional Suspension.


Article 36. Unchallenged Killing
A user proven to be killing another character without challenge by using another account of his own or owned by a friend/family, or owned by someone else, for the purpose of increasing his Kill Points is punishable by Stat Devoid to his Kill Points.


Article 37. Flooding
Consecutive sending of non-sense or repetitive messages in the chat function of Shaiya is punishable by Provisional Silence.


Article 38. Illegal Representations
Pretending to be a Game Master or Warden, using their names unauthorized, or pretending to be their agents is considered fraud. Anyone found guilty of fraud shall be punished by Provisional Suspension to Perpetual Suspension.


Article 39. Scamming and Deceit
A false promise of payment or reward of any form in exchange of an in-game service, favor, currency, item or items from another player or abuse of any trade bug, is punishable by Provisional Suspension.


Article 40. Slander
Use of words to deliberately insult or offend another person or persons belonging to the same faction, or are sexual or defamatory in nature even if used against a person of the opposite faction or directed to no one but can be seen in public, shall be punished by Provisional Silence in its maximum period to Provisional Suspension in its minimum period if it is of a serious and insulting nature.


Article 41. Exposition of Personal Information of Another User
Divulging personal information of another user without his or her consent shall be punished by Provisional Silence to Provisional Suspension in its maximum period if it is of a serious and compromising the safety or privacy of another user.


Article 42. Racism and Blasphemy
Use of words that disrespect any religion, philosophy, belief, and or real life race, culture, and or country, city or province shall be punished by Provisional Silence to Provisional Suspension in its maximum period depending on the gravity of the words used.


Article 43. Vexation
Persistently causing torment or any emotional suffering to another person. This can be done through the following:

a. Intentional, repeated stealing of lured monsters by a person or persons belonging to the same faction, through the use of luring skills of Defender, Guardian or any other class with a similar skill.

   Penalty: Block for 3 days for first offense; at the discretion of the GMs for second offense

b. Intentional, repeated stealing of lured monsters by a person or persons belonging to the same faction, for the purpose of regenerating the Hit Points of the lured monster.

   Penalty: Block for 3 days for first offense; at the discretion of the GMs for second offense

c. Intentional, repeated killing of lured monsters by a person or persons belonging to the same faction to intentionally impede the gameplay of the affected victim or victims. 

   Penalty: Block for 3 days for first offense; at the discretion of the GMs for second offense

d. Intentional, repeated killing of monsters lured by a person's party member or members belonging to the same faction.

   Penalty: Block for 3 days for first offense; at the discretion of the GMs for second offense

e. Intentional, repeated luring of monsters with Area of Effect (AOE) skills by a person or persons for the purpose of involving other person or persons belonging to the same faction in the lowering of the hit points caused by the AOE skills of the lured monster.

   Penalty: Block for 3 days for first offense; at the discretion of the GMs for second offense

f. Claiming of grinding areas not restricted to the felon's faction, level or as restricted by Amped through impeding the gameplay of a victim or victims as stated in Art 43 a, b, c, d, and e.

   Penalty: Block for 3 days for first offense; at the discretion of the GMs for second offense

g. Depravation of the right of a person or persons to successfully accomplish his/her quest by killing a quest boss monster such as Asmo, Knight and Kargos, Corrupt Pharos, Duplicate Rapiouru, Ankylul Wilddark, Azman ElfVein, Lumultan Bloodstorm, and Astaroth without prioritizing the person taking the quest.

   Penalty: Whole party will be blocked for 7 days
